Trial v. Settlement in Georgia Car Accidents
If you’ve been in a car accident, is it better to try to have your attorney negotiate a settlement or to gear up for a full-blown trial?
In Georgia, most car accidents are settled during the pretrial negotiation process. This generally is beneficial for all parties as it is more cost-effective. Additionally, under Georgia law an insurance company must accept or deny liability within 60 days. Thus, car accident claims are resolved more expeditiously. This does not mean you will get a settlement check within 60 days, however. Typically, it will take from 6 to 9 months for the insurance company and your attorney to negotiate a settlement that is acceptable to both parties.
By contrast, trials can drag on for years. There are many formalities involved in trials, including discovery and developing evidence, opening statements, the presentation of evidence, closing arguments, and deliberations by the judge and/or jury. Note that if you want to have a trial, you must file your claim within two years under Georgia’s statute of limitations. The benefit of going to court is that, with a solid case, you are more likely to receive more compensation that an insurance company would offer you in a settlement.
