Georgia Statute of Limitations for Car Accidents
The Georgia statute of limitations, which sets the deadline for filing a lawsuit, is two years for car accidents. This is the same statute of limitations that applies for other personal injury and wrongful death actions. Regardless of the validity of your case, if you fail to file within the two-year limitation period, your claim will be time barred.
There are several exceptions to this statute of limitations. For example, if a minor child was involved in an accident, the two-year time period does not begin to run until the child turns 18 years old. Similarly, if an injured party is deemed incompetent, the statute doesn’t run until the incompetency ends.
Note that if the State of Georgia, or a Georgia county, is a defendant to the action – such as a Fulton County school bus or a State of Georgia Department of Transportation (DOT) vehicle- the deadline is generally shortened to one year.
Additionally, before you can file a claim against a Georgia city or municipality, such as against the City of Atlanta if a MARTA Bus was involved in your accident, you must file a special notice within six months after the accident.
